As per GOI, MHA (IS-IV) order No. 17017/14/2010-IS-I dated 19/07/2010, NIA took over the investigation of FIR No. 49/2010 dated 03/05/2010 of S. Bhavani Nagar, Hyderabad and re-registered the case on 22/07/2010 at PS. NIA, Delhi as Case No. RC-08/2010/NIA/DLI under section 120-B r/w 122,123,124-A of IPC, Section 25(1) (B) (a) of Arms Act, Section 5 of Explosive Substances Act and Section 16, 18, 18 (B), 20 and 23 of UA(P) Act.

Summary of Allegations

On 03/05/2010, based on credible source information, SIT, Hyderabad apprehended one Mohd Zia – Ul-Haque s/o Mohd Shareef (Member of LeT), aged 34 years, a cab driver by occupation, resident of 18/08/534/A/16, Kumarwadi Colony, Edibazar, Bhavaninagar, Hyderabad and recovered a hand grenade and a cell phone (LG make) without SIM card from his possession. The SIT team further seized a pistol with magazine and 06 nos. of live cartridges, hand grenade and other incriminating material from his house on his confession leading to recovery.

Present Status

Charge sheet was filed before the Hon’ble IVth Additional MSJ Court, NIA, Hyderabad on 29/10/2010 against one accused person. On 29-1-2014, the Hon’ble NIA Special Court , Nampally, Hyderabad convicted accused Mohd Zia Ul Haq @ Jani @ Abdullah and awarded him a punishment of 7 years rigorous imprisonment and imposed a fine of Rs. 1000/- under Section 5(b) of the Explosives Substances Act.
